Male Netizen Seeks Help For Girlfriend Working as “Kasambahay” Earning P3k/Month
A male netizen sought help from the authorities for his girlfriend who is working as a “Kasambahay” earning P3, 000 per month.
A netizen named Jayson Derit has brought his concern to “Sumbungan ng Bayan” as he seeks help for his beloved girlfriend working as a housemaid but only earns P3, 000 per month. His girlfriend is working at least 12 hours a day.
Atty. Ansheline Mae Bacudio released a statement regarding Derit’s sentiments. She explained that a domestic helper’s monthly salary will depend on its area, according to the Domestic Worker’s Act.
The act defines domestic helper as someone performing domestic works in employment relationship. House helper, nurse maid, caregiver, yaya, cook, gardener, and laundry person are included on the act.
Bacudio said that house helpers in the National Capital Region should receive a minimum wage of not less than P5, 000 per month based on the directives of the National Wages Productivity Commission of Department of Labor and Employment.
The lawyer explained that the minimum wage outside NCR ranges from P2, 000 to P4, 000. Under the law, house helpers are entitled for at least eight hours of rest if stay-in and 24-hour straight rest per week.
However, the domestic helper and its employer can make an agreement when it comes to off-hours and rest day. Employees who will work after the working hours shall receive overtime pay.
The Kasambahay Law only requires employers to give their house helpers a rest day every week. The remaining work hours can be settle through arrangement.
Atty. Bacudio advised Derit to ask his girlfriend if she had made an agreement to her employer when it comes to salary and work hours.
