The Good Conduct Time Allowance Act, also known as RA 10592, is a statute that reduces offenders’ prison sentences for good behavior. But, two legislators stressed that people convicted of severe crimes should not benefit from this.

Davao City Rep. Paulo Duterte and Benguet Congressman. Eric Yap advocated for this. The two MPs introduced House Bill 4649 to amend RA 10592 and clarify who is eligible for a reduced sentence.

The full title of the bill reads, “An Act defining good conduct and providing conditions in the grant of Good Conduct Time Allowance (GCTA), further amending for the purpose Article 97 of Act No.3815, otherwise known as the Revised Penal Code, as amended by Republic Act (RA) No.10592.”

The proposed measure, according to Rep. Duterte and Yap, will “close apparent gaps” in RA No.10592, or the GCTA Law. Murder, infanticide, kidnapping, significant illegal detention, robbery with violence, damaging arson, rape, and the importation, sale, and manufacture of illegal narcotics are all heinous crimes, based on the report.

The secretary of the Department of Justice is also required under HB 4649 to develop clear guidelines for the Bureau of Prisons, the Bureau of Jail Management and Penology, and wardens of province, district, or city jails for providing credit to convicts. Duterte and Yap requested that Congress approve their idea immediately.

The writers stated that the previous occurrence, which allowed heinous-crime prisoners to profit from the GCTA law, jeopardized public safety and eroded Filipinos’ trust in the law and the institutions involved. While the GCTA law encourages rehabilitation and restorative justice, they argue that it should clearly exclude people guilty of terrible crimes.
