New: R.A 10911 Anti-Age Discrimination Law in the Philippines

The new R.A 10911 Anti-Age Discrimination Law was implemented recently. One of the law’s authors Representative Emi Calixto-Rubiano. Age is now not a qualification or requirements for a certain job.

This law will restrain companies from laying off their employees at the age of 60. Also when hiring or promoting employee’s age doesn’t matter discrimination of employee regarding with age, penalty will be sanctioned.

On Tuesday (August 09, 2016) the new law shows that retirement at the age of 60 is voluntary companies cannot force the employee to retire if he or she doesn’t yet want to retire according to Rubiano.

Rubiano emphasize that contractors can refuse to employ an applicant by other valid reasons and not by age. As long as the individual is capable of the job he is qualified to stay on the job until the employee will retire voluntarily.

  1. What if there is an existing CBA between company and employees that contains a clause stating that retirement is at 60 yrs. old? Does this law “overrule” this particular item in the CBA? Now, what if the CBA was drafted, agreed and implemented way before RA 10911 was p(removed)ed and covers the period for 2015-2020? Will the law have authority over this?
