Supreme Court Confirms Receiving Petition Filed by VP Sara Duterte; Senate Urged To Act On Impeachment Trial

SARA DUTERTE – The Vice President filed a petition challenging the 4th impeachment complaint filed against her.

Undeniably, Vice Pres. Duterte is one of the most controversial politicians since 2024. The public also noticed a souring relationship between her and Pres. Bongbong Marcos. The two (2) highest officials in the country were running mates and looked very close during the 2022 election campaign.

However, in 2023, Vice Pres. Duterte unexpectedly resigned from being the secretary of the Department of Education (DepEd). She also left the cabinet of Pres. Marcos. Since then, the Vice President has been throwing tirades against the Chief Executive.

Vice Pres. Sara Duterte is also being questioned regarding the Confidential Funds use of the offices she handled. Impeachment complaints have been filed against the Vice President before the House of Representatives.

A few weeks ago, the House of Representative ruled in favor of impeaching Vice Pres. Duterte. Presidential son and Ilocos Norte 1st congressional district representative Sandro Marcos was one of those who signed the impeachment rap versus Duterte.

The younger Marcos has previously slammed Duterte when the Vice President issued tirades against his father, Pres. Bongbong Marcos, and his leadership, as well as dragged the name of his late grandfather, former Pres. Ferdinand Marcos Sr., in her statement.

Recently, Vice Pres. Sara Duterte filed a petition challenging the validity and constitutionality of the 4th impeachment complaint against her. Based on a report on ABS-CBN News, the Vice President filed a Petition for Certiorari and Prohibition.

The said petition includes an urgent application for a Temporary Restraining Order and/or Writ of Preliminary Injunction. It was filed before the Supreme Court. SC spokesperson Camille Ting confirmed that the high court has received the petition but it was not discussed during the en banc session on the same day it was filed.

In her petition, Vice Pres. Sara Duterte stated that the first three (3) impeachment complaints were allegedly not transmitted by the House Secretary General to the Office of the House Speaker. However, the fourth impeachment complaint signed by 215 lawmakers in the House was allegedly transmitted to the Senate on February 5.

“By doing so, respondent House of Representatives deliberately circumvented and violated the One-Year Bar, and ran roughshod over and made a mockery of the procedures under the Constitution and the House Rules on Impeachment,” Duterte state in the petition.

Amid the calls for the Senate to act on the impeachment trial, Senate Pres. Chiz Escudero said that the Senate will not force Duterte to attend the impeachment trial.
