In 2016, De Lima was one of those who secured a seat in the Senate. However, she was detained due to the drug charges filed against her. The former Senator was accused of being involved in the drug trade inside the New Bilibid Prison when she was the Justice Secretary.

The then-Senator denied the allegations against her. She also believes that the cases filed against her were politically-motivated. It is no secret to the public that De Lima had heated exchange of statements versus then President Rodrigo Roa Duterte.
