Chel Diokno Gives Legal Advice vs “Bastos” Customers and Case Against Them

Human rights lawyer Chel Diokno gives legal advice against “bastos” customers and the possible cases that can be filed against them.

The human rights lawyer explained on TikTok that not all consumers are always correct. He stated that if a customer abuses or harasses a member of the staff, it may be considered a violation of the law.

The lawyer provided legal advice regarding impolite customers in his TikTok video. He considers embarrassing someone to be an ‘Unjust Vexation’ offense.

“Paano kung nagtatrabaho ka naman nang maayos tapos binastos ka ng customer? Puwede yang ituring na paglabag sa batas,” said Diokno.

“Una, ang pagpapahiya ng tao ay puwedeng ituring na krimen na ‘Unjust Vexation’ which is any human conduct that causes annoyance, irritation, torment, distress, disturbance, kahit walang physical or material harm na ginawa,” the human rights lawyer explained.

He went on to say on his video that it might also result in a civil complaint for damages under the Civil Code’s human relations section, which lays out basic rules for treating fellow human beings in articles 19, 20, and 21. He also emphasized the need of treating others with respect.

“Pangalawa, maaari rin itong maging sanhi ng civil case for damages sa ilalim ng human relations provision ng Civil Code read articles 19, 20, and 21 ng Civil Code na naglalatag ng basic principles para sa tamang pagtrato ng kapwa tao,” he said.

“Sa madaling salita, ‘respeto.’ Always treat others with respect. at huwag i-expose ‘yung iba sa unnecessary ridicule, shame at indignity,” he added.
