Property Owner Builds Fences Along Illegal Settler’s Path in Rodriguez, Rizal

A property owner has closed the right of way of illegal settlers residing near the vicinity in Barangay San Isidro, Rodriguez, Rizal.

The residents of Sitio Masaguksok Barangay San Isidro, Rodriguez, Rizal were struggling to climb the wall just to get in or out of their village after a property owner build a wall on their right of way. About 36 families were affected by the closure.

The illegal settlers are residing in the area for more than two decades. They were just using the subdivision’s wall to pass because there is no other way to get out of the area aside from the property.

In 2017, the owner reportedly talked to the residents and informed them regarding the fencing of the property. However, the issue was not settled until the owner decided to build fences around the vicinity.

According to the Civil Code of the Philippines Easement of Right of Way Article 649 Section 3:

“The owner, or any person who by virtue of a real right may cultivate or use any immovable, which is surrounded by other immovables pertaining to other persons and without adequate outlet to a public highway, is entitled to demand a right of way through the neighboring”

Unfortunately, the residents have no right because they were just illegal settlers in the property. The complainants admitted they have no right, according to the law but they are hoping that the owner will give them consideration. The owner also refused to give a statement regarding the issue.

The illegal settlers were also asking for a relocation site in case the subdivision prohibit them to climb the wall.
