Pay Rules & Guidelines for November Holidays Released by DOLE

The Department of Labor and Employment (DOLE) has released the pay rules and guidelines for November holidays.

The Labor Department has issued the guidelines regarding the payment of workers for the upcoming holidays including All Saints’ Day on November 1, All Souls’ Day on November 2, and Bonifacio Day on November 30.

DOLE releases Labor Advisory No. 19-21 stating the guidelines for the pay rules for the November holidays. November 1 has been declared as a special non-working day, November 2 as special working day and November 30 as a regular holiday.

The government also set an exception to establishments that have totally closed or ceased operation during coronavirus pandemic. These establishments are exempted from the holiday payment on November 30 based on the advisory.

The announcement came after President Rodrigo Duterte approved the Proclamation No. 1107 declaring the following dates: November 2, 2021 – All Souls’ Day, December 24, 2021 – Christmas Eve, and December 31, 2021 – New Year’s Eve as special working day.

The bill has been approved to strengthen the country’s economy amid the health crisis.

Here are the guidelines for holiday pay rules:

November 1 (All Saints’ Day)

  • If worker did not report to work “no work no pay” policy shall apply
  • Worker should receive an additional 30% of his/her basic wage on the first eight hours of work
  • Overtime work shall be paid an additional 30% of his/her hourly hour rate during the holiday
  • Employers must pay an additional 50% of worker’s hourly rate if the holiday falls on its rest day
  • Employees are entitled for an additional 30% of his/her hourly rate (150%) during overtime work

November 2 (All Souls’ Day)

  • No premium pay is required

November 30 (Bonifacio Day)

  • Worker must receive 100% of its salary during a regular holiday if he/she did not report to work, 200% if employee report to work
  • Overtime work shall be paid an additional 30% of his/her hourly hour (200%) rate during the regular holiday
  • Employers must pay an additional 30% of worker’s hourly rate (200%) if the holiday falls on its rest day
  • Employees are entitled for an additional 30% of his/her hourly rate (200%) during overtime work
