DOLE Issues Holiday Pay Rules for Ninoy Aquino (August 21) & National Heroes Day (August 30)

HOLIDAY PAYDOLE has urged the employers to observe the holiday pay rules for Ninoy Aquino and National Heroes Day.

The Department of Labor and Employment (DOLE) has reminded the business owners and employers to follow the holiday pay rule for the special non-working and regular holidays this August 2021.

Labor Secretary Silvestre Bello III ordered the private businesses and companies to give the proper payment deserved by the Filipino workers during the observance of Ninoy Aquino (August 21) and National Heroes Day (August 30).

DOLE explained that private institutions are still required to obey the ruling amid the implementation of community quarantine in various parts of the country. Ninoy Aquino Day has been declared as a special non-working holiday while National Heroes Day has been declared as a regular holiday.

Bello said that “no work, no pay” remains in effect unless a company policy grants collective bargaining agreement (CBA) for the special holiday. Employees are entitled to receive an additional 30 percent of their basic salary during that day for the first eight hours.

If a worker exceeds eight hours, he/she is entitled to an additional 30 percent of their hourly rate. If the employee’s rest day fall on a special non-working holiday, he/she must receive an additional 50 percent of their basic wage and 30 percent additional for their hourly rate.

Meanwhile, workers who will not report during a regular holiday shall receive 100% of their wage and 200% for those who will work. Employees who will work overtime shall receive an additional 30% of their hourly rate.

The employees who will work on their rest day during a regular holiday shall receive additional 30% of their basic wage of 200% for that day.
