Holiday Pay Rule for Labor Day (May 1), According to DOLE

The Department of Labor and Employment (DOLE) reminded the employers of holiday pay rule for Labor Day (May 1).

DOLE Secretary Silvestre Bello III has issued an advisory informing the private sectors to observe the mandated wages on May 1, 2021 (Labor Day), which is considered as a regular holiday in the Philippines.

Bello announced that the employees who will report to work during the holiday are entitled to receive 200 percent of his daily wage for the first eight hours. If the worker would go overtime work, he/she shall receive an additional 30 percent of its hourly rate.

Holiday Pay Rule

If the worker did not work during the regular holiday, he/she is entitled to receive 100 percent of its daily salary. If the regular holiday falls on the worker’s rest day, he/she shall be paid an additional 30% of its basic wage of 200 percent.

“For work done in excess of eight hours (overtime work) during a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30% of his/her hourly rate on said day,”  the advisory said.

However, private companies that have ceased or suspends their operation during the coronavirus-related lockdown are exempted from the payment of the holiday pay.
