Employers Shall Observe Pay Rules for April 9-10, 2024, DOLE Says

DOUBLE PAY – The Department of Labor and Employment (DOLE) reminded employers to observe pay rules for April 9-10, 2024.

DOLE issued Labor Advisory No. 05, series of 2024, stating that employees from the private sector who reported to work on April 9 (Araw ng Kagitingan) and April 10 (Eid’l Fitr) are entitled to double pay.

The Labor Department explained that employers shall pay a total of 200% to the workers who reported to work during the two regular holidays. The double pay covers the first eight hours of work.

“For work done during the regular holiday, the employer shall pay a total of 200% of the employees’ wage for that day for the first eight hours,” said DOLE.

However, employees who render overtime during the regular holidays. Work done more than eight hours is entitled to an additional 30% of the hourly rate on the holiday.

Workers who will render duty on a regular holiday that also falls on his/her rest day shall receive an additional 30% of the basic wage of 200%. Overtime pay during this day calls for an hourly rate of the basic wage x 200% x 130% x 130% multiplied by the number of hours worked.

Workers who did not report for duty during a regular holiday must receive 100% of his/her daily wage pay.

Here are the pay rules:

  • If employee did not work: employee is paid 100% (Basic wage x 100%)
  • For work done: employee is paid 200% (Basic wage x 200%)
  • For work done in excess of 8 hours or overtime work, the employee is paid an additional 30% of the hourly rate on the said day;
  • For work done during the employee’s rest day, the employee is paid an additional 30% of the basic wage of 200%;
  • For work done in excess of 8 hours or overtime work during employee’s rest day, the employee is paid an additional 30% of the hourly rate on the said day.
