Former Pres. Rodrigo Duterte’s ICC Lawyers Makes Submission To Court Challenging its Jurisdiction

Duterte’s ICC lawyers Nicholas Kaufman and Dov Jacobs cited the letter of President Bongbong Marcos to Vice Pres. Sara Duterte in their submission to the International Criminal Court.

The lawyers of former Pres. Rodrigo Duterte recently made a submission where they insisted that the ICC cannot exercise jurisdiction in the Philippines. The legal team of the former president includes British-Israeli lawyer Nicholas Kaufman and French lawyer Dov Jacobs.

Former Pres. Duterte is detained in the Hague, Netherlands for more than a month now. He is faced with an allegation of crime against humanity over his administration’s war on drugs. His unexpected arrest last March 11 brought political turmoil in the Philippine government.

Pres. Bongbong Marcos earned countless criticisms over the arrest of Duterte. Many Filipinos slammed the President for allowing the transfer of the custody of the former President. Malacañang defended Marcos Jr. saying the government only did its job on Duterte’s arrest and acted on its commitment with the International Criminal Police Organization.

Pres. Marcos previously claimed that every single necessary step in the arrest was done. He also claimed that the PH government acted on the arrest not because it came from the ICC but because of its commitment with the Interpol.

In its submission to the International Criminal Court, based on a report on PhilStar, Duterte’s ICC lawyers included the letter of former Pres. Bongbong Marcos to Vice Pres. Sara Duterte. The said letter was dated December 15, 2023.

Based on the report, in the said letter, Pres. Bongbong Marcos assured Vice Pres. Sara Duterte that the government will not “assist the ICC, in any way, shape or form”. Former Pres. Rodrigo Roa Duterte’s ICC lawyers included it in their 38-page challenge to the court.

“I am certain that all members of my Cabinet, including yourself, will echo my views on the matter,” the President reportedly said in his letter to the Vice President.

A copy of the said letter was part of the Senate investigation of presidential sister Senator Imee Marcos on Duterte’s arrest. Despite her feud with the President, Vice Pres. Sara Duterte is endorsing the senatorial bid of Sen. Imee Marcos.
