Online backlash rushed to Philippine Senator Robin Padilla following his queries to lawyer Lorna Kapunan about marital consent. Speaking to the human rights lawyer, he asked what should be done if the husband is in the mood but the wife is not on the same page.
Kapunan responded that when it comes to matters like this, a no means no, even between two people who are already married. This response surprised Padilla who followed up the question asking, “So paano ‘yun kung ayaw ng asawa mo? So wala pong ibang paraan talaga? Para ma-ano ‘yung lalaki, so paano ‘yun, mambabae ka na lang ba?”
During the Committee on Public Information and Mass Media, he expressed that in his belief, a spouse is there to serve whenever things like this happen. He then asked what a husband can do to to make her agree and Kapunan gave him two options: counseling or pray.
She also suggested that he could just watch Netflix. Kapunan stressed that if a wife refuses, this must be respected no matter what the reason is. And “with all due respect”, the lawyer highlighted that it is not the wife’s obligation to ‘serve the husband’.
A clear no means no which applies to all genders. In case the partner forces when other refuses, it shows lack of respect and could become a ground for annulment based on their discussion.
The queries of Padilla sparked online bashing with some calling the statements disgusting. Prominent human rights lawyer Jose Manuel Diokno said in a post that men don’t have rights like this over their wives stressing “women have equal rights and free will”.
