The Land Transportation Office (LTO) has issued a memorandum that effectively prohibits the confiscation of motor vehicle license plates.

The agency prohibits its law enforcers and deputized agents to confiscate motor vehicle plates during traffic apprehensions. This decision comes in response to the complaints received by the agency regarding the confiscation practice.

LTO Chief Jay Art Tugade, in issuing the memorandum, aims to address the confusion surrounding the confiscation of license plates.

The statement clearly states that all LTO enforcement personnel and deputized agents are now strictly prohibited from confiscating motor vehicle plates as a substitute for physically impounding the apprehended vehicles.

“To avoid further confusion, all LTO enforcement personnel and its deputized agents shall be prohibited from confiscating motor vehicle license plates in lieu of the physical impoundment of the apprehended motor vehicles,” Tugade said.

The memorandum further emphasizes that quick implementation may be impossible in circumstances when the punishment involves the confiscation, suspension, or revocation of a driver’s license and suspension or revocation of a motor vehicle’s registration or impoundment.

In such cases, the driver’s license, student permission, or motor vehicle will be placed on hold until the appropriate penalty is carried out.
