Decision of Supreme Court on Case Filed by Mel Tiangco Against ABS-CBN Out
SUPREME COURT – The High Court released a decision on the petition filed by broadcaster Mel Tiangco against the ABS-CBN network.
Some of the people working under the GMA-7 Network now have previously worked under its rival network, the ABS-CBN, and viva versa. One of the Kapuso who has worked under the Kapamilya network several years ago is broadcaster Mel Tiangco.
However, based on a report on Inquirer, in 1996, Mel faced suspension from ABS-CBN due to her appearance in a commercial soap in 1995. The talents and employees of the Kapamilya network who appear on-air and on-camera were not allowed to participate in any ad campaign.
Mel Tiangco filed a petition against the ABS-CBN Network seeking separation pay, damages, and attorney’s fees from the media giant. The Supreme Court recently released a decision regarding the petition filed by the veteran broadcaster.
Based on the report, the Supreme Court junked the petition filed by Mel Tiangco against the ABS-CBN Network. The decision was dated December 6, 2021 but it was only released recently. The Court found that the broadcaster was an independent contractor and not an employee of the network then making her not entitled to receive the compensation demanded.
The SC made the decision even with the Partial Settle Agreement between Mel and the network. According to the Court, the petitioner also failed to establish the claim that the network controlled the manner in which she did her job as the news anchor for TV Patrol.
Based on the report, the Supreme Court found that Mel Tiangco performed her job as a news anchor for TV Patrol based on her own manner and method and free from the control of the network.
