13TH MONTH PAY 2020 – Here are some guidelines about 13th month pay whether resigned or terminated employees are still entitled to have this or not.

What every employee is surely looking forward to every month of December is the 13th month pay from their respective companies. This monetary benefits it mandated by law and every employee is entitled to have this on or before December 24.

13th Month Pay 2020

As per Presidential Decree No. 851, S. 1975, entitled “Requiring All Employers to Pay their Employees a 13th-Month Pay”, this law was passed to help the people have something in their table to celebrate Christmas. The section 1 has stated: All employers are hereby required to pay all their employees receiving a basic salary of not more than P1,000 a month, regardless of the nature of their employment, a 13th-month pay not later than December 24 of every year.

Now, what if an employee has been terminated in the company or has resigned? Are they still entitled to received their 13th month benefits? All rank-and-file employees who have accordingly worked a minimum of a month in a company is entitled to have it. When we say rank-and-file employees, they are people who are not in managerial position.

This is 1/12 of the total basic salary of an employee has made within a calendar year. And to those who resigned or got terminated, as per law, they are still entitled to receive the benefit. Meaning, if someone has worked in this certain company from January to September of 2020, the 1/12 of the total of his basic salary within that period will be his or her 13th month benefit.
