The Court Of Sandiganbayan Earlier Declared The Trial Of 194 Malampaya Cases
SANDIGANBAYAN COURT – The Sandiganbayan anti-graft court recently proclaimed the formal court trial of 194 Malampaya cases.
The Malampaya Natural Gas powers major power plants generating electricity in Luzon regions. The gas supply of the said source could last until 2024.
Meanwhile, 194 criminal cases were forwarded to the court of Sandiganbayan with regards to the alleged misapplication of P900 million revenue of the government from the Malampaya Project.
A resolution was implemented last Friday (May 10, 2019) stating that the Third Division of the Sandiganbayan’s court rejected the motion for reconsideration of the accused. incumbent Representative of Camarines Sur Rolando Andaya Jr. sought the reversal of the court’s ruling on March 6 rejecting the legislators appeal to void the charges.
The court’s Third Division claims that Andaya failed to submit his appeal on time and there were no new assertions from the legislator that would provide legal document to officially authorize the setback of the preceding decision.
Sandigan also claimed that the information sheets for the case were complete and adequate in structure and content. The claim contrasts Andaya’s claims referring to the sheets as “fatally defective” as prosecution did not specifically state how he participated in the alleged crime and how he reportedly collaborated with the co-accused.

The court’s Third Division wrote in the resolution explaining the case:
“Going now to the issue of sufficiency of form, a plain reading of the present [case] information will show that the acts and/or omissions complained of are alleged in plain, ordinary and concise language.”
Rolando Andaya Jr. and another accused could face 97 counts violating the Republic Act 3019 dubbed the “Anti-graft and Corrupt Practices Act.”
Also under the Revised Penal Code, 97 counts of: Malversation of Public funds by Falsification of public documents.
