Richard Gutierrez Tax Evasion Case junked by DOJ.

RICHARD GUTIERREZ – The tax evasion, falsification of public documents, and perjury charges Richard Gutierrez was facing dismissed by DOJ.

In a previous report, the Bureau of Internal Revenue (BIR) has filed charges against actor Richard Gutierrez and his company RGUTZ Productions Company for allegedly not paying right amount of tax.

He has undeclared sales in 2012 amounting P39.9 million as his company of the same year did not file a yearly income tax return and value added tax returns, thus, actor and his firm has “an estimated aggregate deficiency tax liability for taxable year 2012 in the total amount of P38.57 million”.

Moreover, BIR filed another charges against the Kapamilya actor for allegedly submitting falsified documents of his annual tax document – 6 counts of of “knowingly using/submitting falsified Quarterly Value-Added Tax (VAT) for the second to fourth quarter of 2012″ and 2 counts of violating Article 183 of Revised Penal Code over falsified affidavit.

And just recently, the Department of Justice (DOJ) has dismissed the complaints due to lack and insufficient evidence for the actor to be charged in court.

The resolutions were prepared by Assistant State Prosecutor Christine T. Perolino and with the sign and approval of Acting Prosecutor General Richard Anthony Fadullon. As stated in the resolution, GMA has withheld taxes from the actor as per the attached certification on Gutierrez’s counter-affidavit.

“Likewise the subject returns submitted by respondent [Gutierrez] showed that RGUTZ filed its returns and accordingly paid its taxes,” the resolution has also further indicated.

Thus, Richard Gutierrez was clear of tax evasion, perjury charges, and falsification of public documents as per Inquirer’s report.

Gutierrez is a famous actor under the Kapamilya network coming from the prominent Gutierrez clan
