Lawmakers Questioned The Time Of Serving Search Warrants Against The Accused
Several lawmakers have questioned why do the police authorities served the search warrants against Paronijogs in darkness.
On Monday (July 31, 2017), two senators wanted to conduct probe regarding the death of Ozamiz City Mayor Reynaldo Parojinog Sr, his wife, and 14 others, which is similar to the death of AlbueraMayor Rolando Espinosa Sr.
Senate Minority Leader Franklin Drilon is wondering why do the police authorities need to serve the search warrants for the accused during night-time. Both Parojinog and Espinosa died after the police authorities have served search warrants in darkness.
The Albuera and Ozamiz Mayor were both tagged drug lords, which sparked curiosity among the lawmakers. Drilon also said that the Senate was currently conducting a lot of investigations regarding those unusual incidents.
Drilon also cited the Section 9, Rule 126 of the Rules of Court and said that the authorities should serve search warrants during the daytime.
“Generally, a search warrant should be served in the daytime. While it may also be served any time of the night, the issuing judge must so expressly specify in the search warrant,” said by Drilon quoted by Inquirer.
Senator Francis Escudero agreed on the statement of Drilon and said that it is also the general rule under the Philippine National Police manual. He also said that the police had a lot of explaining to do and he will not be surprised if lawmakers will file a resolution to investigate both Parajinog and Escudero cases.
However, Senator Panfilo Lacson sees no reason to conduct probe unless further development about the case will exist.
PNP Chief Bato Dela Rosa also defended the raid stating that every time is a legal time to serve a search warrant for it was carried out to gain maximum advantage. He also said that they have to be able to predict the tempo of the operation.
