SELLING STOLEN ITEMS – A lawyer revealed the punishment for the people who are caught selling items that were taken from the owner through stealing.

Stealing or illegally taking an item from another person or establishment is a crime. Not only that, it is also no secret to the public that selling the said item is punishable under the law.

Not only the one who took the item from its owner may be charged but as well as the person, the establishment, or another party that is selling it to another person or to the public. There is a corresponding punishment that awaits the person, establishment, or party involved.

Based on a report on ABS-CBN News, speaking to DZMM, lawyer Claire Castro revealed the punishment that awaits the person caught selling stolen items. It is in line with a recent issue in Manila.

In the capital city, the local government warned to close two(2) shopping malls. It is over the allegation that the said malls allow the selling of mobile phones that were taken from their owners through stealing.

Based on the report, the lawyer stressed that selling stolen items is a violation against the Anti-Fencing Law. It covers a single individual or a company doing it with the intention to gain.

“Ito ay mga tao or anything pati kompanya na magbebenta ng nakaw na bagay with intent to gain. Gustong kumita. Magbenta, mag-dispose, magpalit ng gamit na nakaw o walang legitimate na pinanggagalingan at alam nila,” she said.

According to the lawyer, the person or company must be aware that the items were not taken legally before they can be punished. Based on the report, with regards to the punishment for selling stolen items, a prision mayor awaits those found guilty.

The prision mayor is equivalent to six(6) to twelve(12) months of imprisonment for violating the anti-fencing law. In the case of shopping malls, they can be shut down most especially if they have no business permit.
