Retired Supreme Court Associate Justice Antonio Carpio said Executive Secretary Ralph Recto could face plunder and technical malversation charges if the Supreme Court rules that the Bureau of the Treasury (BTr) unlawfully used ₱167 billion in trust funds to finance flood control projects.
Based on the report, in an interview on Bilyonaryo News Channel’s “On Point” program Carpio stressed that the transfer of ₱60 billion from the Philippine Health Insurance Corp. (PhilHealth) and ₱107 billion from the Philippine Deposit Insurance Corp. (PDIC) allowed the flood control program to proceed despite the funds being legally restricted.
Carpio expressed, “Technical malversation is a situation where the law (is) saying that this money should be used to build schoolhouses, you used the money to build a bridge. When you did not obey it, that is what you call technical malversation. Whether you actually received a single centavo or not is immaterial because you did not follow the law.”
He added that the PhilHealth and PDIC remitted the funds under the directive of the Department of Finance, which was then headed by Recto as finance secretary. This was accordingly “unconstitutional,” as the funds should only be used as the law has mandated.
“It will be plunder because this is a series because there were two transfers and there were also transfers from several tranches from PDIC,” he explained.
