Rodrigo Duterte Remains Davao Mayoral Candidate Despite ICC Arrest

RODRIGO DUTERTE – Ex-president Rodrigo Duterte remains a candidate for Davao City mayor despite his arrest and impending trial at the International Criminal Court.

Former Philippine President Rodrigo Duterte remains a candidate for mayor of Davao City despite his recent arrest and transport to The Hague to face trial for alleged crimes against humanity at the International Criminal Court (ICC), according to the Commission on Elections (Comelec).

Comelec Commissioner Ernest Maceda clarified during the Kapihan sa Manila Bay forum yesterday that Duterte has not withdrawn his candidacy or been disqualified from the mayoral race.

“He is still a candidate because the only way to stop him from running in the elections is if he withdraws his candidacy,” Maceda said. He added that even if Duterte is convicted, he cannot be barred from running unless the ruling is final.

Maceda also noted that Duterte has the option to campaign even while he is outside the country. “Duterte has the option to campaign while outside the country,” he said.

Comelec Chairman George Garcia confirmed that Duterte’s name would remain on the ballot for the upcoming May 12 elections, and voters in Davao City could still vote for him. Garcia explained that a final conviction is required before Duterte could be disqualified from running for office.

“We cannot say if he will be convicted here or abroad. In the meantime, he will remain a candidate, and his name will still be included in the ballot,” Garcia stated.

According to the report, Garcia also mentioned that the Comelec does not have the authority to initiate a disqualification case against Duterte unless a formal complaint is filed. If such a case is filed, the poll body would take appropriate action.

The Comelec addressed concerns raised by Vice President Sara Duterte over potential election tampering, assuring that safeguards are in place to protect the integrity of the results.

If Duterte wins but is unable to assume office due to legal or logistical reasons, Maceda said that the vice mayor would take over the role as outlined by the law.

Regarding reports that money was distributed during a campaign rally attended by Duterte in Hong Kong, Maceda said the Comelec did not pursue an investigation as the case falls outside its jurisdiction and no formal complaint or evidence was presented.

Duterte was arrested by the Philippine National Police on Tuesday upon his arrival from Hong Kong.
