Senator Risa Hontiveros releases a statement after the Supreme Court declared VP Sara Duterte’s impeachment articles unconstitutional.

After months of buzz and exchanges of statements, the Supreme Court has finally issued its ruling regarding the impeachment trial of Vice President Sara Duterte. The SC declared the articles vs. VP Sara unconstitutional.

As reported, Duterte is accused of six allegations:

  • Conspiracy to Assassinate President Marcos, First Lady, and Speaker Romualdez
  • Malversation of P612.5 Million in Confidential Funds
  • Bribery and Corruption in DepEd
  • Unexplained Wealth and Failure to Disclose Assets
  • Involvement in Extrajudicial Killings (Davao Death Squad)
  • Destabilization, Insurrection, and Public Disorder

“The SC has ruled that the House impeachment complaint versus VP Sara Duterte is barred by the one-year rule and that due process or fairness applies in all stages of the impeachment process,” the Supreme Court’s spokesperson, Atty. Camille Ting announced.

Following the decision, Senator Risa Hontiveros issued a statement regarding the ruling and aired her disappointment. She acknowledged the High Court’s statement about not absolving the vice president from any of the charges against her, and that “any subsequent impeachment complaint may only be filed starting February 6, 2026.”

However, the female senator expressed that there are “disturbing questions about the short-term and long-term consequences of this ruling.”

Hontiveros questioned the interpretation, pointing out the SC’s own 2011 ruling in Gutierrez vs. House. She cited what the Supreme Court has stated: “The measure of protection afforded by the Constitution is that if the impeachable officer is made to undergo such ride, he or she should be made to traverse it just once.”

What was also concerning was that the Court had added an excessive number of requirements to initiate the impeachment process. Hontiveros expressed in her statement that she could only hope that this latest decision wouldn’t hinder future attempts to ensure accountability among our top government officials.
