Darryl Yap Charged With Cyberlibel Due To Pepsi Paloma Movie Teaser

Muntinlupa RTC charges Darryl Yap with cyberlibel due to the teaser of his movie.

Film director Darryl Yap has been indicted as Muntinlupa prosecutor charged him with cyber libel over his movie’s teaser.

Eat Bulaga host Vic Sotto filed 19 counts of cyber libel against Darryl Yap whose film became highly controversial. It created an even louder buzz online when the trailer of the Pepsi Paloma film was released and clearly mentioned the host’s name with a heavy accusation.

Sotto filed a petition to issue the writ of habeas data which was already granted by the court, and he also sought a total damage of Php 35 million.

Recently, dated March 17, the Office of the City Prosecutor accused Yap of libel under Articles 353 and 355 of the Revised Penal Code. He violated Republic Act 10175, or the Cybercrime Prevention Act of 2012.

The city prosecutor stated that the scene defamed Sotto, “thereby exposing the latter to public contempt, hatred, dishonor, or ridicule or causing the latter’s reputation to be tarnished.”

He will be facing two counts of cyber libel which stemmed from the 19 counts filed by Sotto.

In the trailer of the Pepsi Paloma film, artists Gina Alajar as Charito Solis and Rhed Bustamante as Pepsi Paloma shared a scene where Solis asked Paloma if she was really assaulted by Sotto. The latter response was “Oo!” in a loud voice.

The recommended bail for each count is Php 10,000.00 and Assistant City Prosecutor Elvin Keith Barrios also added in the resolution:

“I HEREBY CERTIFY, that the crime or offense charged in this case has a prescribed penalty of not more than six (6) years of imprisonment without regard to fine and hence, an expedited preliminary investigation was conducted in this case pursuant to Section 8, Rule V of DOJ Department Circular No. 28 series of 2024…”
