Here’s DOLE Guidelines on Holiday Pay Rules this December 2024
DOLE – The Department of Labor and Employment issued guidelines on the pay rules for the employees for the December holidays.
The holidays are undeniably among the most awaited days in a year by many people. Truth be told that apart from being the opportunities to join the celebration, the holidays may mean other things to many people.
That is why many people check the list of holidays in the Philippines ahead as many people take these days as a lot of individuals plot their vacations or much-awaited trips with family and friends during holidays. Many even do it on holidays that pave the way for long weekends.
In other cases, employees take the holidays as opportunities to get extra pay on top of their basic daily salary. These days can be chances to augment the other financial needs in the household.
Now that we are on the last month of the year and we are on a holiday season, there are several special non-working days and regular holidays that are fast-approaching. These days will bring an extra pay to employees who will report to duty.
With regards to the holiday pay, the Department of Labor and Employment or DOLE has set the rules for it. In fact, it has recently issued a reminder for the employers with regards to the holiday pay rules.
Here are the guidelines issued by DOLE regarding the December holiday pay:
Special Non-Working Days
December 8 (Feast of the Immaculate Concepcion)
December 24 (Christmas Eve)
December 31 (last day of the year)
- “No work, No pay” rule applies if the employee does not report for work unless the company has issued a favorable policy.
- Employees who report to work will get a holiday pay that is equivalent to 30% of the basic daily salary for the first eight (8) hours of work.
- After the first 8 hours of work, an employee who continues working is entitled to an additional of 30% of the hourly rate on the said day (hourly rate of the basic wage x 130% x 130% x number of hours worked).
- In case the special non-working day falls on his/her rest day but the employee reports to work, he/she is entitled to 50% of the basic daily salary for the first 8 hours of duty. After the first 8 hours of duty, the employee who continues to work is entitled to 0% of the hourly rate on said day (hourly rate of the basic wage x 150% x 130% x number of hours worked).
Regular Holidays
December 25 (Christmas Day)
December 30 (Rizal Day)
- An employee is entitled to a holiday pay equivalent to 100% of his/her basic daily salary whether or not he/she reports to work on a regular holiday provided that the employee reports to work the following day or is on a leave of absence.
- According to DOLE, if the employee reports to work on a regular holiday, he/she will get 200% of the basic daily salary as wage for the day.
- If the employee continues working after 8 hours of duty on a regular holiday, he/she is entitled to an additional 30% of the hourly rate on said day (hourly rate of the basic wage x 200% x 130% x number of hours worked).
- In case a regular holiday falls on the rest day of the employee and he/she reports to work, the employee is entitled to an additional 30% of the basic wage of 200% (basic wage x 200% × 130%).
- If the employee continues working after 8 hours on a regular holiday that is supposedly his/her rest day, DOLE stated that he/she must be given an additional 30% of the hourly rate on said day (hourly rate of the basic wage x 200% x 130% x 130% x number of hours worked).
