Chiz Escudero On Posting Private Messages Without Consent

Senate President Chiz Escudero weighs in on an issue related to a recent celebrity controversy.

The conversation between Maris Racal and Anthony Jennings has been leaked and Senate President Chiz Escudero has this to say about it.

The split became messy after the screenshots were shared and became a highly publicized issue.

Atty. Jesus Falcis previously discussed the legal implications of sharing private messages. According to him, the act sparked some risks, as posting private messages is grounds for cyber libel charges and violates data privacy.

Falcis reiterated that screenshots must be used for court. If a victim, especially married, holds screenshots, the best thing to do is to file a Violence Against Women case for psychological violence caused by infidelity.

The same things were echoed by Senate President Chiz Escudero. During the Kapihan sa Senado, Escudero was asked about the proper way of handling personal messages and screenshots.

There are other ways for safe exchange of messaging such as deleting them or using the disappearing feature. In terms of posting screenshots on social media, this is accordingly a violation of data privacy laws.

He also noted the jurisprudence that states while the act is illegal, it may still be used as evidence in criminal cases and not in civil cases. It is allowed in criminal cases to prove innocence or guilt and not in civil cases to pay or to take any properties.

“Para patunayan ang innocence or guilt ng akusado pero hindi sa isang civil case para mapagbayad o mabawi anumang ari-arian. So yung ang pagkakaiba nun,” he explained.
