DOLE Issues Holiday Pay Rules for August 21, 2023 (Ninoy Aquino Day)
The Department of Labor and Employment (DOLE) has issued a reminder to employers regarding the holiday pay rules for August 21, 2023, which marks Ninoy Aquino Day.
Last week, Secretary Bienvenido Laguesma signed Labor Advisory No. 17, Series of 2023, which outlines the proper computation of employees’ wages for two upcoming holidays: August 21 (Ninoy Aquino Day) and August 28 (National Heroes Day).
The labor department has provided detailed guidelines for the payment of wages for August 21, which falls on a Monday and is recognized as a national non-working holiday in the Philippines.
The key points include:
- If employees worked, they should receive an additional 30 percent of their basic wage for the first eight hours of work. If they worked overtime, an additional 30 percent of their hourly rate is due.
- Employees who worked on this holiday, even if it’s their regular rest day, are entitled to an extra 50 percent of their basic wage for the first eight hours. If they worked overtime, an additional 30 percent of their hourly rate is applicable.
The agency also emphasizes that the ‘no work, no pay’ principle applies to employees who did not report to work on this day. However, if a company policy, practice, or collective bargaining agreement (CBA) grants payment for special days, the ‘no work, no pay’ policy can be overridden.
These rules are established based on Proclamation No. 42, Series of 2022, as revised by Proclamation No. 90, Series of 2022, which sets out the regular and special (non-working) days for the year 2023.
