Private Employers Reminded by Labor Department Regarding Holiday Pay Rules on Election Day (May 9)

The Department of Labor and Employment (DOLE) has reminded the private employers regarding the holiday pay rules on Election Day (May 9).

On Monday (May 9, 2022), the Labor Department has reminded the Filipino private employers regarding the holiday pay rule for employees who will report to work. The agency instructed the employers to observe the 30 percent additional payment during the election holiday.

DOLE made the announcement after President Rodrigo Duterte has issued Proclamation No. 1357 declaring the May 9, 2022 national and local elections as a special non-working holiday.

Labor Secretary Silvestre Bello III said that workers who will report to work during the Election Day are entitled to receive an additional 30 percent on their first eight hours of work Under Labor Code’s Chapter III, Article 94.

“We highly encourage our workers who are registered voters to exercise their rights to suffrage, and if they will report to work on May 9 after casting their votes, they must receive an additional 30% in their daily pay,” Bello said.

The Labor Department said that workers who will work over shall receive basic wage x 130 percent x 130% percent x number of hours worked. If the holiday falls on worker’s rest, he/she shall receive an addition 50 percent of its basic wage for the first eight hours of work.

Overtime work during laborer’s rest shall be paid a basic wage x 150% x 130% x number of hours worked.
