Cheating Husband Sentenced by Supreme Court of 8 Years Imprisonment & P100k Fine
The Supreme Court has sentenced a cheating husband of up to eight years imprisonment and ordered to pay a fine of P100, 000.
SC’s Third Division rejected the appeal filed by the accused and affirmed with modification the decision of the Court of Appeals. Zambales trial court has sentenced the man guilty for allegedly violating the law prohibiting violence against women and children.
The high court set a punishment of a minimum of six months and one day to a maximum of eight years and one day behind bars. The court also ordered the guilty man to pay a fine of P100, 000 for causing mental or emotional anguish to its wife.
The court also ordered the cheating man to undergo psychiatric treatment and submit a confirmation of his completion to the court within 15 days. The decision of the court dated January 13, 2021.
The helpless wife revealed that her husband has been womanizing and had been drinking frequently in their 23 years of marriage. The woman and her kids were evicted after having a quarrel with her husband.
Three of their kids were left at the petitioner’s custody and eventually lived with the man’s new girlfriend. The husband claimed that his wife could not have suffered mental violence because she do not know his marital infidelity.
“In this case, other than bare denials, herein petitioner did not proffer any convincing defense to disprove the testimony of his wife and daughter about his marital infidelity,” SC quoted the decision of Associate Justice Edgardo delos Santos.
