Jobert Sucaldto files illegal dismissal case against DZMM
Talent manager/radio host Jobert Sucaldito files illegal dismissal complaint against DZMM following issue with Nadine Lustre.
Recalling, Jobert reprimanded Nadine on his radio program Showbuzz. This was after the actress slammed entertainment columnist Ricky Lo who confirmed her breakup with James Reid. Because of that, the columnist received bashing from te JaDine fans.
Jobert defended Ricky on his radio program and this did not sit well with the fans also. It reached to the point that the attention of ABS-CBN News Chief Ging Reyes was called. She stated on her Twitter post that the management will address this program.
Followimg this, Jobert posted on his Facebook account ranting against the radio station for suspending him without pay. To top it all, it was indefinitely. Based on the article from PEP, it has been almost two months since he was suspended.
In line with this issue, Jobert Sucaldito files a case against the management of DZMM. Together with Atty. Ferdinand Topacio, the radio host went to Department of Labor and Employment (DOLE).
Jobert’s lawyer stated that it’s unfair that the radio station suspended him indefinitely, especially that he has an existing contract.
Here’s the statement of Atty. Topacio:
“Sinabi ko sa kanila na i-reinstate si Mr. Sucaldito within ten days. Kasi, alam niyo, ang indefinite suspension is tantamount to constructive dismissal. Ibig sabihin, hindi man gamitin yung term na dismissal, parang tinanggal ka na rin. Kasi, hindi mo alam kung ibabalik ka, kung kailan ka ibabalik. Pagkatapos, ang masaklap pa nga rito, suspension without pay, hindi naman puwedeng indefinite yun. That’s not fair, kasi may kontrata siya na kare-renew lang niya nung January. It’s a year contract.”
The radio host also said that what happened really hurt him. He tried to follow orders such as apologizing just to appease the fans. However, based on the article, he said that the management could have addressed the issue more properly because after all they are Kapamilya.
