Supreme Court Denies Quo Warranto Petition Against Duterte

QUO WARRANTO PETITION VS DUTERTE – The Supreme Court denied the quo warranto petition filed against Philippine President Rodrigo Roa Duterte.

In June 2018, a quo warranto plea against Pres. Rodrigo Roa Duterte was filed by a suspended lawyer, Elly Pamatong. He claimed the presidential post and accused Pres. Duterte of taking the post not in a legal manner.

Pamatong claimed that the Certificate of Candidacy (COC) filed by the former Davao City Mayor in 2015 was “not allowed by law” according to a report in ABS-CBN News.

The suspended lawyer claimed that filing of a COC for another position after withdrawing of a COC in a position is not allowed under the law. He was pointing at the withdrawal of Duterte’s COC for Davao City mayor.

Recently, the Supreme Court has given its decision on the quo warranto petition filed against Pres. Rodrigo Roa Duterte by Elly Pamatong.

Based on a report, in a 7-page resolution, the Supreme Court denied the complaint of Pamatong seeking to invalidate the assumption of Pres. Duterte of the presidential post.

In its resolution, the Court stressed the prescribed period for such petition is only one year and Pres. Duterte was inaugurated on June 30, 2016.

Furthermore, the court is also in the common ground with the camp of the President in their comment that Pamatong does not have the “legal standing to bring an action for quo warranto”.

Based on the report, the suspended lawyer previously declared that he “took an oath as caretaker” of the Republic of the Philippines and on June 30, 2016, was seated as the president of the country.
