Camp of Sen. Bongbong Marcos has filed a complaint versus the executives of Smartmatic for the not permitted change in the script of Commission on Elections transparency server.

Marlon Garcia, the head of Smartmatic’s technical support team who earlier announced that the script of COMELEC transparency server changed was charged over violation of the Automated Election System Law.

Jonathan Dela Cruz, the campaign adviser of Bongbong Marcos, named Ellie Moreno, Smartmatic project director; Neil Banigued, member of the Smartmatic Technical Support Team, and Rouie Peñalba, IT officer of the Comelec in a 14-page complaint affidavit as among who were allegedly involved in the change of transparency server script.

“The act of ‘tweaking’ the script of the transparency server caused widespread anxiety and concern amongst the nation,” Dela Cruz stated.

“The lapses in protocol have undermined the credibility and integrity of the 2016 elections,” added Dela Cruz- who’s also a representative of Abakada Partylist.

Based upon the report of Inquirer.net, the identified respondents were charged for violating “Sections 35 (b) and (c) of Republic Act No. 8436, as amended by RA 9369, otherwise known as the Automated Elections Law.”

The Automated Elections Law forbids meddling with “the generation, transmission of election results, data or information.”

The law also constrains “gaining or causing access to, using, altering and destroying computer data, program and system software, network, or any computer-related devices, facilities, hardware or equipment, whether classified or declassified.”
