DOLE to Kasambahay: Report Non-Compliance of 13th Month Pay Provisions

The Department of Labor and Employment-Regional Office No. 2 (DOLE 2) urged all “kasambahays” or househelp to report non-compliance of their employers with the 13th month pay provision of Republic Act (RA) 10361, otherwise known as the Domestic Workers Act or Batas Kasambahay.

According to DOLE Regional Director Atty. Sixto T. Rodriguez, Jr., “Under Rule IV, Section 8 of Batas Kasambahay, one of the rights and privileges of a Kasambahay is 13th month pay.” as reported on Interaksyon.

Under Republic Act (RA) 10361, otherwise known as the Domestic Workers Act or Batas Kasambay, in Article IV Section 30 “The domestic worker shall be entitled to all other benefits under existing laws.”

The DOLE Regional Director added further that “A kasambahay who has rendered at least 1 month of service is entitled to 13th month pay which shall not be less than 1/12 of his/her basic salary earned for the year,” Rodriguez added.

The 13th Month Pay of all Kasambahays shall be paid not later than December 24 of every year or upon separation from employment.

DOLE advised kasambahays to visit the nearest DOLE Office and look for the designated Kasambahay Desk Officers to file a complaint if they are not given their 13th month pay.
