CIDG Can Access Internet Data Without Court Order According to Dir. Gen. Pagdilao

According to the New Anti-CyberCrime Law, the Criminal Investigation and Detection Group (CIDG) can access internet data even without a court order, Director General Samuel Pagdilao, Chief of the CIDG stated on Tuesday.

The controversial Anti-CyberCrime Law stated however, that the access will be limited to origin, destination, size and time of Data, Pagbilao clarified during a forum as netizens from around the Philippines have feared for the law that can be use to violate people’s privacy.

The information that can be accessed by law enforcers are only those that are related to a crime being investigated, (–foul word(s) removed–)uring that they cannot pry into the contents of the data.

The Chief of the Anti-Transnational and Cybercrime Division of the CIDG, Robert Reyes was also quoted as saying that “we work only based on complaints filed. We cannot monitor everyone.” Reyes said.

Most of the cybercrimes that have been recorded so far by the agency were identity theft, online scams, child (–foul word(s) removed–)ography, fraud and voyeurism.

With regards to the most heated debate regarding libel cases, Pagdilao said, “The same safeguards will come in to ensure that the rights of our people will [not be violated.” Pagdilao stated.

The CIDG Chief adds further that the implementing rules and regulations of the anti-cybercrime act have yet to be drafted, it will help the authorities to implement the law.
