Acting Davao Mayor Baste Duterte Files Complaint before the Ombudsman

BASTE DUTERTE – The acting Mayor of Davao City has filed multiple charges against several government officials over the arrest of his father, former President Rodrigo Roa Duterte.

Since March, former Pres. Rodrigo Duterte is in The Hague, Netherlands. He is detained under the custody of the International Criminal Court (ICC) and he is faced with an accusation of crimes against humanity over his administration’s drug war.

It was last March 11, upon his arrival from Hong Kong at the Ninoy Aquino International Airport in Pasay City when Duterte was arrested by the Philippine authorities who assisted the International Criminal Police Organization (Interpol). The arrest was reportedly in lieu of the arrest warrant issued by the ICC against the former President.

Duterte spent his 80th birthday inside the ICC detention facility in The Hague. Recently, his lawyer, Nicholas Kaufman, claimed that former Pres. Rodrigo Duterte is allegedly unable to recall events, places, or even members of his close family. His client is allegedly suffering from ‘cognitive impairment’ that will either remain ‘static’ or deteriorate further even with a medical intervention.

The ICC ruled to postpone the confirmation of charges hearing of Duterte which was initially set on September 23 following the claim of the former President’s lawyer. It was only a few weeks ago when Vice Pres. Sara Duterte claimed that the foreign court barred them from disclosing information about their visits to her father inside the ICC detention facility.

Former Pres. Rodrigo Duterte’s lawyer requested the ICC to adjourn all legal proceedings indefinitely. Currently, the former President’s camp has a pending application to the ICC for the interim release of the former Chief Executive.

Amid the former President’s detention, his children — Davao Congressman Paolo Duterte, Vice Pres. Sara Duterte, acting Davao Mayor Baste Duterte, and Kitty Duterte, take turn in visiting him inside the ICC detention facility. The Vice President previously claimed that not all the needs of her “super senior citizen” father can be provided inside the ICC detention facility.

Recently, based on a report on GMA News, acting Davao City Mayor Baste Duterte filed multiple charges against some government officials involved in the arrest of his father, former Pres. Rodrigo Duterte, for the transfer of his custody to the ICC.

Acting Davao Mayor Baste Duterte was accompanied by Atty. Israelito Torreon in filing his complaints before the Office of the Ombudsman for Mindanao. Based on the report, the respondents of the case are:

  • Justice Undersecretary Nicholas Felix Ty

  • Anthony Alcantara
  • Richard Anthony Fadullon
  • Brigadier General Jean Fajardo

Based on the report, the charges filed by acting Davao City Mayor Baste Duterte were ‘kidnapping, arbitrary detention, qualified direct assault, expulsion, usurpation of judicial functions, all under the Revised Penal Code, and for alleged violation of the Anti-Graft and Corrupt Practices Act (R.A. 3019)’.

A few weeks ago, before the postponement of the confirmation of charges hearing, the ICC allowed all four (4) Duterte siblings to visit former Pres. Rodrigo Roa Duterte altogether inside the ICC detention facility. It was really a request of the Duterte patriarch.
