Former Justice Carpio Speaks on Resolutions over Ex-Pres. Rodrigo Duterte Case before ICC
RODRIGO DUTERTE CASE – Retired Supreme Court Associate Justice Antonio Carpio believes that the Senate and House resolutions “will not matter” to the International Criminal Court (ICC).
Recently, Sen. Alan Peter Cayetano filed a Senate resolution calling for the house arrest of former Pres. Duterte. The same resolution calls on the Philippine government to urge the ICC to grant the interim release bid of the former Chief Executive.

Cayetano cited former Pres. Duterte’s old age, deteriorating health, and prolonged social isolation in the resolution. According to him, it is allegedly an injustice towards the former Chief Executive to deny him of family time in his twilight years.
In his resolution, Sen. Alan Peter Cayetano suggests the house arrest of former Pres. Rodrigo Duterte at the Philippine embassy in The Hague, Netherlands. His resolution came amid an interim release bid of the Duterte camp.

Previously, the camp of former Pres. Rodrigo Duterte moved to seek for his interim release to an undisclosed country. According to Vice Pres. Sara Duterte, not all the needs of her 80-year-old father can be provided inside the ICC detention facility.

Previously, a resolution was filed in the House of Representatives seeking to block the interim release bid of former Pres. Duterte. Department of Justice Secretary Boying Remulla was also quick to oppose the interim release bid of the former President.

However, as for Retired Supreme Court Associate Justice Antonio Carpio, he believes that the Senate and House resolutions have no weight before the ICC. Based on a report on PhilStar, he stressed that the foreign court has already acquired jurisdiction over the former Chief Executive.
“Well, it will not matter… because the ICC has acquired jurisdiction over the person of former President Duterte. And they’ve already said that they have jurisdiction,” Carpio told ANC Headstart.
According to the former Supreme Court Justice, the congressional resolutions, whether they are supporting or against former Pres. Duterte, they will not influence the ruling of the International Criminal Court. Based on the report, he stressed that, for him, the resolutions are “just noise”.
Retired Supreme Court Associate Justice Antonio Carpio believes that the congressional resolutions are more on gathering support that influencing the ruling of the ICC. He claimed that those pro-Duterte resolutions are “just trying to play to the gallery, to the DDS [die hard Duterte supporters] people”.
