During Duterte’s term, the International Criminal Court started a probe on the war on drugs of the previous administration. It looked into the alleged deaths of innocents due to the drug war. The investigation visibly did not sit well with the then-President. He removed the country from being a member of the ICC.

In its recent statement following the arrest of former Pres. Rodrigo Roa Duterte, the ICC noted that “the case against Mr. Duterte falls within the jurisdiction of the Court as the alleged crimes occurred during the period when the Philippines was a State Party to the Rome Statute, the ICC’s founding treaty”.
