The issue with the Eat Bulaga Trademark is not yet over for TAPE Inc.
Television and Production Exponents (TAPE) Inc. is not yet giving up the Eat Bulaga Trademark case against the camp of the iconic TVJ trio of Tito Sotto, Vic Sotto, and Joey de Leon.
When TVJ decided to cut ties with TAPE, they weren’t able to bring the noontime show title with them. The production company fought that they had the right to use the name which Joey claimed he created. Because of this, TVJ opted to use the E.A.T. name for their noontime show on TV5.
It has been published in EB’s coffee table book that the Henyo Master coined the term and eventually became a household name.
On December 5, the Intellectual Property Office of the Philippines (IPOPHIL) favored TVJ. In a decision, the agency stated that TVJ (petitioner) was able to establish how the Eat Bulaga mark was coined and this was not done by TAPE’s camp.
This decision made EAT hosts ecstatic. Fans of the iconic trio and the Dabarkads also expressed happiness that finally they got the right to use the Eat Bulaga trademark.
However, this fight is not yet over for TAPE Inc. Following IPOPHIL’s decision, the legal counsel of the Kapuso noontime show released a statement on GMA’s primetime news program 24 Oras.
Atty. Marie Glen Abraham-Garduque said that TAPE’s lawyer in charge of the IPO cases, Atty. Siao has not received yet the decision regarding this matter. However, if the decision indeed favored the other camp, TAPE can still appeal. “TAPE Inc. will avail of all legal actions to reverse this decision,” Atty. Abraham-Garduque said.
