Joey de Leon was on the witness stand for his statement against TAPE Inc.
Henyo Master Joey de Leon is the first witness for the unfair competition complaint that TVJ filed against TAPE Inc. and GMA Network.
The said complaint was prompted by the decision of the Jalojos-owned production company and the Kapuso network to air past episodes of Eat Bulaga when TVJ decided to leave.
Based on the article in PEP, TVJ also wants TAPE to stop using the title Eat Bulaga, including the segments and the audio-visual recordings. To recall, Joey stressed that he was the one who created the title of the longest-running noontime show.
The hearing for the application for the issuance of a writ of injunction filed by Tito Sotto and Jeny Ferre, the former creative director of TAPE Inc. Judge Romeo Dizon Tagra ng Branch 273 ng Regional Trial Court is the presiding judge and the hearing commenced on the morning of July 27, 2023, Thursday.
Joey de Leon underwent direct, cross, redirect, and recross examination when he gave his statement. Atty. Enrique dela Cruz of Divina Law office, the legal counsel of the complainant, said that they are also planning to put Tito Sotto on the witness stand.
TAPE’s legal counsel, Atty. Maggie Abraham-Garduque, stressed, “TAPE Inc. has the trademark registration of the name and logo of Eat Bulaga!, it has the right to use the name and logo of Eat Bulaga!.”
Garduque also said that TAPE has the “trademark registrations of the segments” and the “copyright of all the audiovisual recordings.” “As regards the audiovisual recordings, TAPE Inc. insisted that they own the copyright thereof because they spent for all the expenses of production to be able to make those episodes,” TAPE’s legal counsel said.
