2 Philippine Soldiers Charged for Allegedly Killing Yvonette Plaza in Davao
Two (2) Philippine Army soldiers face charges after being accused of being involved in killing Yvonette Plaza in Davao City.
Lt. Gen. Romeo Brawner Jr, the PA commander, stated that copies of the charges had been served on the two Armed Forces commanders, Brig. Gen. Jesus Durante and Col. Michael Licyayo, who were involved in the December 28 killing of a businesswoman and model in Davao City. They have already filed their counter-affidavits.
In a military court, the two were charged with breaking Articles of War 96 and 97. Article 96 is known as “Conduct Unbecoming an Officer and a Gentleman” whereas Article 97 refers to “Conduct Prejudicial to Good Order and Military Discipline “, based on the report.
A conviction under Article of War 96 will result in the offender’s expulsion from military service. Those found guilty of breaking Article 97 will be convicted by a military court and punished at the court’s discretion.
He further stated that another lawsuit could be filed against the suspect officers and enlisted men involved. Staff Sgt. Gilbert Plaza, Corporal Adrian Cachero, Rolly Cabal, and Romart Longakit were the enlisted men engaged in the case.
“Basically these are the Articles of War 96 and 97 but there might be other charges also not just against these two officers but also against the enlisted personnel, so we are still in the phase where (we) are conducting the initial investigation or pre- trial investigation,” added the PA chief.
