DOLE Reminds Employers on Holiday Pay Rules for December 24, 25, 30 and 31, 2019

The Department of Labor and Employment reminded the employers regarding the holiday pay rules for December 24, 25, 30 and 31, 2019.

Over the past few weeks, most Filipino people are already busy preparing for the upcoming Christmas Day and New Year’s Eve. Many consumers are already purchasing grocery items and gifts for the upcoming holiday.

Business establishments such as malls, restaurants, and other entrepreneurs are very busy accommodating the customers. Employees are also required to exert extra effort and to work overtime during the Yuletide Season.

Holiday Pay Rules

Recently, DOLE reminded the employers regarding the holiday pay rules for the upcoming Christmas holidays.  The pay ruling is based to Proclamation No. 555 signed by President Rodrigo Duterte.

December 24 and 31 are special non-working holidays while December 25 and 30 are regular holidays. “No work, no pay” principle shall be applied during the holidays unless there is a company policy granting payment on a special holiday.

Here is the holiday payment guidelines:

Special Holiday

  • 8 hours of work = Basic salary x 130% + COLA
  • 8 hours of work + overtime = Hourly rate of basic salary x 130% x 130% x number of hours worked
  • 8 hours of work during rest day = Basic salary x 150% + COLA
  • 8 hours of work during rest day plus overtime = Hourly rate of basic salary x 150% x 130% x number of hours worked

Regular Holiday

Employees shall receive 100 percent of his salary if he/she did not work

  • 8 hours of work = Basic salary + COLA x 200%
  • 8 hours of work + overtime = Hourly rate of basic salary x 200% x 130% x number of hours worked
  • 8 hours of work during rest day = Basic salary + COLA x 200% + 30% (Basic salary x 200%)
  • 8 hours of work during rest day plus overtime = Hourly rate of basic salary x 200% x 130% x 130% x number of hours worked
