Prisoner Claims Life Sentence Is Over After Being Momentarily Dead

PRISONER – A convict from Iowa claimed his life sentence was over when he died momentarily and was revived.

Does dying momentarily in prison mean that your life sentence is technically over? This prisoner sure hopes it does.

A convict by the name of Benjamin Schreiber argues that because he momentarily died in prison, his life sentence was ended. He was hit with sever septic poisoning and was revived by doctors.

The medical staff had to restart his heart five times before he was brought back to life. That was back in 2015.

Now, the prisoner is filing a legal appeal that stated that since he had died before he was resuscitated, he technically served his life sentence. However, judges aren’t buying it.

Based on an article from Chron, dying for a brief period of time doesn’t get you out of jail. Last week, the Iowa court ruled that the 66-year-old convict would remain in prison until he is dead for good.

“Schreiber is either alive, in which case he must remain in prison, or he is dead, in which case this appeal is moot”, said Judge Amanda Potterfield. The prisoner had been in jail since 1996.

She added that they do not believe the legislature intended this provision to set criminal defendants free when medical procedures during their sentence lead to their resuscitation by medical professionals.

The district court judge was not convinced by the “creative loop hole” in the law. She explained that the prisoner’s argument was unpersuasive and without merit.
