According to the news report released by the Inquirer, the Comelec chief is allegedly receiving commissions from referring companies which at such are Smartmatic, Baseco and United Coconut Planters Bank (UCPB), to DivinaLaw, one of the law firms which has a fast growth.

This has been based upon the sworn statement by his estranged wife Patricia Bautista.

The wife disclosed to public several checks and commission sheets which had allegedly come from Nilo T. Divina, DivinaLaw’s managing partner.

Meanwhile, Smartmatic is the company that provides the machines which are used to count votes during 2010, 2013 and 2016 elections of the country.

Baseco and UPCB are the companies that are hidden away by the Presidential Commission on Good Government (PCGG).

PCGG is tasked to recover the ill-gotten wealth of the late dictator of the Philippines, President Ferdinand Marcos, and his cronies.

Andres Bautista is the chairman of the PCCG from September 2010 until his appointment to be the chairman of Comelec on May 2015.

Patricia surrendered several sheets of the commission to the Nationa Bureau of Investigation. The sheets contained varying amounts from 2015 to 2016.

However, other sheets have amounts P560 to P29,470 to as high as P95,663.

On an interview with the Inquirer, Bautista did not deny that he is close to Divina for he is not only one of his lawyers but also the lawyer of his stepfather-in-law, Dr. Daniel Vazquez.

As per the commission sheets, Bautista just said, “These are not public funds …. It’s not a commission but it’s like a referral. This is private and does not involve government. It was an arrangement we had even before I joined [the] government but these are small amounts.”
