Arraignment Of David Lim Jr. Reset By The Regional Trial Court

The Regional Trial Court (RTC) has reset the arraignment of the road rage gunman David Lim Jr. who was charged with homicide and illegal possession of firearms.

Mr. David Lim Jr. was the suspect in the road rage shooting happened in Barangay Kamputhaw, Cebu City last March 19, 2017. Lim shot Ephraim Nuñal during a traffic altercation. Nuñal has suffered from several gunshots from the suspect.

The Cebu road rage suspect voluntarily surrendered himself to the authorities on March 21, 2017, 2 days after the traffic altercation happened. Lim was immediately turned over to the Central Visayas Police.

Regional Trial Court

Esteban Mendoza, the new lawyer of Mr. Lim filed a petition asking to remand the case back to the Cebu City Prosecutor’s Office. Mendoza also wanted to conduct an investigation on Lim.

Judge Ricky Jones Macabaya of RTC Branch 5 gave 15 days to the prosecution to comment on the pleading filed by Lim’s camp. The arraignment of the accused was moved to June 20, 2017.

“My client was arrested without a warrant of arrest and so the inquest proceedings conducted by the prosecutor after his arrest was void. Now, we’re seeking the conduct of the regular preliminary investigation,” said by Mendoza quoted by Inquirer.

Mendoza replaced lawyer Orlando Salatandre Jr, who was originally representing Lim. Salatandre withdrew his appearance in the court due to the alleged conflict in his schedule, so he was replaced by Mendoza, who is originally based in Manila.

Lawyer Mundlyn Misal-Martin, counsel of the victim were opposing Lim’s request to remand the case back to Cebu City Prosecutor’s Office. Misal said that it was only a strategy of the accused and the court has already the jurisdiction over Lim.
