Supreme Court Orders Immediate Release Of Rolito Go

Supreme Court has ordered the release of the road rage convicted killer Rolito Go and can be released as of Friday (December 16, 2016).

The release order of Go was immediately executed as it was received by the Bureau of Corrections Director in Muntinlupa. Go’s release petition was declined by the Supreme Court last November 28, 2016.

“You are hereby ordered to immediately release Rolito T. Go unless there are other causes for which he should be further detained, and to return this Order with the certificate of your proceedings within 5 days from notice hereof,” said by the order given by Associate Justice Presbitero Velasco Jr. quoted by Rappler.

Roliti Go was sentenced to life imprisonment or reclusion perpetua for his murder case. He was convicted at the New Bilibid Prison (NBP) and he was sentenced last April 30, 1996, and will be released today.

Go’s status was switched by the national penitentiary to ‘Colonist’ which commuted his sentence on July 30, 2008. Bureau of Corrections director Oscar C. Calderon issued a certificate of eligibility and a resolution carried out by the Board.

On January 30, 2014, habeas corpus was filed by Go urging for release. Go argued that he should have been released on August 21, 2013, due to his petition but his original sentence will end by 2022.

Muntinlupa regional trial court granted the petition of Go. His sentence was validly reduced from reclusion perpetua to 30 years.  Articles 70 and 90 of the Revised Penal Code recognize partial reduction or commutation of sentences.

The trial court was right saying that the president has the authority to reduce the sentence of a prisoner, said by Supreme Court’s Third Divison as stated on Go’s resolution.

Rolito shot the 25-year-old Eldon Maguan in the head in 1991 and entered Wilson St. in an opposite direction. Go went against the traffic and causes the most sensational road rage incidents in the Philippine history.
