US Supreme court was asked by Obama Administration’s executive action to rehear the Controversial immigration case on which the eight-member court was split 4-4 last month.
July 18, 2016, Monday, Obama administration asked the supreme court of the United States to rehear the immigration case. According to a report, the Justice Department also asked the Court to have a second to the case.
It was unclear and never been in effect to the court decision, the Republican-controlled US Senate has declined to act on Obama’s nominee, appeals court judge Merrick Garland. As such, even if the Supreme Court was to grant the request, it is unlikely to rule on the case until well after Obama leaves office in January.
According to Ian Gershengorn who is now the Acting Solicitor said to an interview, the case was unique as the court could not in future take another case to resolve the issue if the plan is blocked. He noted that the high court should be the final arbiter for the ruling.
The case between United States and Texas are important to be settled but still in place because of politics. November 2014, when Obama unveiled his plan but was never implemented because the lower courts had blocked it.
Republicans in the US House of Representatives killed bipartisan immigration legislation that was passed by the Senate in 2013. According to a report, Republican-governed Texas and 25 other states that argued that Obama overstepped the powers granted to him by the US Constitution by infringing upon the authority of Congress.
