CA Closes ABS-CBN vs Willie Revillame Case

Television giant ABS-CBN’s petition against former network’s host Willie Revillame was recently announced by the Court of Appeals as “moot”, putting an end to the case between two parties.

Associate Justice Amy Lazaro-Javier of the court’s Seventh Division dismissed the special civic action for certiorari filed by the network to question the Quezon City Trial Court Branch 21’s orders om a case filed by Revillame.

In 2010, Revillame complained and demanded for damages over ABS-CBN’s termination of his contract and cancellation of his noon time show.

Revillame filed saying the network “unilaterally, whimsically, oppressively and malevolently cancelled and terminated parties’ agreement pertaining to the show ‘Wowowee’.”

When he later joined TV5, ABS-CBN questioned the move before the QC RTC, asking for a temporary restraining order against the new show.

However, the WC RTC denied the network’s petition and ordered Revillame to post a bond of more than P400 million to answer any damage the network might sustain.

Later, the RTC ordered the bond to be discharged that led the network to elevate the case to the appellate court to question the order.

The appellate court, however, said the development “emphasizes the mootness” of the petition filed by the network.

“ABS-CBN sought to restrain Revillame from creating or performing with ABC’s TV5. Since, Revillame no longer performs with ABC’s TV5, the subject of ABS-CBN’s prayer for TRO no longer exists,” Lazaro-Javier said in the ruling.
