Will Arnold Clavio be imprisoned for Sarah Balabagan’s allegations?

On the issue between Kapuso journalist Arnold Clavio and Sarah Balabagan, the questions about legal matters surfaced and that included, “will he be imprisoned?”

Balabagan, in her Facebook Live, revealing her “past” with Clavio, she stressed that she was 17 years old when they started their relationship. That was after she arrived from the United Arab Emirates after serving her jail time after she killed her employer who reportedly tried to abuse her.

The former OFW also said that her eldest child’s father is Clavio who was already married. As of press time, the Kapuso journalist has not released any statement regarding the accusations against him.

However, the online community has been attacking him for allegedly taking advantage of a minor in her vulnerable state. With this issue, legal concerns have been brought up also. On the day when the name of Arnold Clavio trended on social media due to this issue, former journalist Jay Sonza shared a post about Child Abuse Law.

Sonza stressed that it is a violation of RA 7610 to do a “kalapastanganan laban sa isang below 18 years old.” Does Clavio really commit a crime against a minor 22 years ago? Under this law, the person who is found guilty will “suffer the penalty of prision mayor in its minimum period or imprisonment ranging from six (6) years and one day to twelve (12) years.”

Based on the article from Manila Bulletin, the prescriptive period plays a major role in this issue. Atty. Trixie Cruz Angeles, not a counsel of any of the parties involved, said that child abuse charges may no longer be filed against the journalist.

It is because, in this kind of case, the prescriptive period is between 12 years and one day and 20 years. “If she was 17 when it happened and she filed, there was a crime, but she didn’t, so he gets away with it,” the lawyer said.

If the child of Balagabagan whose alleged father is Clavio is now 21 years old, then, it is already prescribed or expired.

In the question, if the state could file the case against Arnold Clavio on behalf of Sarah Balabagan, the answer is yes but it will go back to the fact that the prescriptive period has ended.
