December 24, 31 Special Non-Working Holiday ‘No Work, No Pay’ – DOLE

“No work, no pay” policy will take effect on December 24 and 31 special non-working holidays

Department of Labor and Employment (DOLE) reminded that the ‘no work, no pay’ policy will take effect on December 24 and 31 special non-working holidays.

The Labor Advisory No. 19-18 from DOLE, stated that the dates mentioned, including the previous December 8 holiday, are considered “special non-working days.  In line with this, if an employee did not work, the ‘no work, no pay’ policy will apply.

However, this will depend if there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.

December 24 and 31 no work no pay

Employees who will work on the aforementioned dates must get an additional 30 percent of the basic salary. Those who are working overtime will also receive an additional 30 percent of hourly rate.

For work done during these days that also fall on employee’s rest day, according to DOLE, an additional 50 percent of the daily rate on the first eight hours will be provided.

Meanwhile, for ‘regular holidays’ on December 25 and 30, employees shall still be paid regardless if they work or not.

Here are the payment conditions from DOLE:

  • If the employee did not work, he/she shall be paid 100% of his/her wagefor that day. (Basic wage + COLA) x 100%)
  • For work done during the regular holiday, the employee shall be paid 200% of his/her wage for that day for the first 8 hours (Basic wage + COLA)x 200%)
  • For work done in excess of eaight hours (overtime work), he/she shall be paid an additional 30% of his/her hourly rate as on said dat (Hourly rate of the basic wage x 200% x 130% x number of hours worked)
  • For work done during a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30% of his/her basic wage of 200% [(Basic wage + COLA) x 200%)] + [(30% (Basic wage x 200%)]
  • For work done in excess of eight hours (overtime work) during a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30% of his hourly rate on the said day (Hourly rate of the basic wage x 200% x 130% x 130% x number of hours worked)
