Makati Mayor Junjun Binay’s Petition for “TRO” Raffled off to the Court of Appeals

The Mayor of Makati City, Mayor Junjun Binay was suspended by the Office of the Ombudsman and will be implemented by the Department of Interior and Local Government (DILG), but his camp filed a Temporary Restraining Order (TRO), his petition has been raffled off to the Court of Appeals’ Sixth Division on Friday, March 13, 2015.

After the raffling of Mayor Binay’s petition, the Court of Appeals is expected to decide whether or not grant Mayor Binay’s urgent plea for the issuance of a temporary restraining order against an Ombudsman joint order preventively suspending him and 15 other Makati City officers for sixth months.

According to a court insider working for the Court of Appeals, assigned as the ponente or the one to write the decision is CA Associate Justice Jose Reyes, the division chairman and Associate Justices Francisco Acosta and Eduardo Peralta as members of the Court of Appeals Sixth Division.

Mayor Junjun Binya and other officers of Makati City were implicated in corruption charges over the alleged overpricing in the Makati City Hall Building II. The son of Vice President Jejomar Binay, Junjun Binay repeatedly denied the charges, and kept on saying that his suspension was illegal.

The Makati City Mayor, was charged with plunder and graft complain by lawyer Renato Bondal last July 2014, noting that the construction of the Makati City Hall Building II was overpriced by P862 million.
